1. Overview of the Service

PocketLeads provides a subscription-based online platform that aggregates and delivers U.S. real estate–related lead data (including Pre-Foreclosures, Divorces, Evictions, Pre-Probates, and Probates) to users for their internal business use. PocketLeads operates software, tools, and databases hosted on Amazon Web Services (AWS) and does not guarantee the completeness or accuracy of third-party data.

These Terms govern your use of:

• The PocketLeads website and platform
• All related applications, tools, and data services
• Any communication or support channels connected to the Service

2. Subscription and Access

PocketLeads offers access to its Service on a monthly or annual subscription basis.

• Subscriptions automatically renew at the end of each billing cycle unless cancelled prior to renewal
• Users may cancel their subscription at any time, but cancellation takes effect at the end of the current billing cycle
• No refunds are provided once a billing cycle has started
• Subscriptions are non-transferable and for use only by the registered account holder

PocketLeads reserves the right to modify or discontinue any part of the Service, with or without notice. You agree that PocketLeads is not liable for any modification, suspension, or discontinuation of the Service.

3. User Accounts

To use the Service, you must create an account and provide accurate, current, and complete information.

• Each account is individual; sharing login credentials or granting access to others is prohibited
• PocketLeads may suspend or terminate accounts found to be shared or used for unauthorized purposes
• You are responsible for maintaining the confidentiality of your credentials and for all activity under your account

4. Permissible Use and Restrictions

You agree to use the PocketLeads Service solely for your own internal business purposes and in compliance with all applicable laws.

You may NOT:

• Reuse, resell, sublicense, or distribute PocketLeads data, content, or materials
• Copy, scrape, or harvest any data to create your own database or derivative work
• Reverse-engineer, modify, or decompile the software
• Access or use the Service in a way that disrupts our systems or networks
• Use the Service to send unsolicited messages, spam, or violate Do Not Call or consumer protection laws
• Use any automated means (bots, scrapers, crawlers) to access or extract data from the platform

5. Data Accuracy and Disclaimer

PocketLeads compiles data from third-party sources and public records.

While we strive to ensure accuracy, we do not guarantee that any data, property information, or leads are accurate, complete, or up-to-date.

All data and reports are provided "as is" for informational purposes only.

You assume full responsibility for how you use the data and any resulting decisions, marketing actions, or communications.

PocketLeads is not responsible for any errors, omissions, or losses resulting from reliance on the information provided through the Service.

6. Payment Terms

• Processor: Payments are securely processed through Stripe
• Billing: Payment is due at checkout and automatically charged at each renewal
• Failure to Pay: Accounts with failed or declined payments may be suspended until resolved
• Taxes: PocketLeads does not collect sales tax; any applicable taxes are your responsibility

PocketLeads may adjust subscription fees with at least 30 days' prior notice by email or account notification.

7. Termination and Suspension

PocketLeads reserves the right to suspend or terminate your access to the Service for:

• Nonpayment
• Violation of these Terms
• Abuse, fraud, or illegal activity
• Misuse of data or unauthorized access attempts

Upon termination, all rights granted to you under these Terms immediately cease. PocketLeads may delete or retain account data at its discretion in accordance with its Privacy Policy.

8. Intellectual Property

All software, databases, designs, text, graphics, code, and other materials within the Service are the exclusive property of PocketLeads LLC or its licensors.

You are granted a limited, non-transferable, non-exclusive license to access and use the Service for your permitted business purpose. You acquire no ownership rights or title to any part of the Service or its data.

9. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy.

By using the Service, you consent to the collection and use of your personal information as described in that policy.

PocketLeads acts as a "Service Provider" under applicable U.S. data privacy laws and does not sell or share personal data collected through the platform.

10. Compliance with Laws

You agree to comply with all applicable federal and state laws, including but not limited to:

• The Telephone Consumer Protection Act (TCPA)
• CAN-SPAM Act
• Fair Credit Reporting Act (FCRA)
• Do Not Call regulations
• State privacy and marketing laws

You agree to defend, indemnify, and hold harmless PocketLeads, its officers, employees, and data providers from any claims, damages, or expenses (including attorneys' fees) arising from:

• Your misuse of the Service or data
• Your violation of these Terms
• Your violation of applicable laws or third-party rights

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles.

Any dispute arising under or relating to these Terms shall be brought exclusively in the state or federal courts located in Delaware, and you consent to such jurisdiction and venue.

14. Electronic Communications and Consent

By using the Service, you consent to receive communications from PocketLeads electronically. These communications satisfy any legal requirement that such communications be in writing.

15. Modifications to Terms

PocketLeads may modify these Terms at any time. The updated version will be posted on our website with a revised "Effective Date." Continued use of the Service after updates constitutes your acceptance of the revised Terms.

16. Severability and Waiver

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.

Failure by PocketLeads to enforce any right or provision shall not constitute a waiver of such right.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PocketLeads regarding your use of the Service and supersede all prior agreements, written or oral.
